Terms of Use

When you use the Laina.fi service, the service provider is Sortter Oy.

Read these terms (Terms) carefully before using the services (Service) of Sortter Oy (Sortter, we).

Access to and use of our Services requires acceptance of and compliance with these Terms. These Terms apply to all users and other persons who have access to our Services. Our Services are offered to you free of charge.

By visiting our website and using our Service, you agree to be bound by these Terms. If you do not accept these Terms or part of them, you may not use our website.

1. General

1.1 These Terms apply to the relationship between you and us, and they determine in detail our mutual obligations.

1.2 The relationship between us is based on the following:

  • information and statements that you have given when registering as a user, as well as other notifications and representations that you have given during our relationship;
  • these Terms.

1.3 If any document sent to you when you begin to use our Service conflicts with these Terms, the content of that other document shall prevail.

1.4 When you use our Service, you and any possible co-applicant accept these Terms.
When we use the term “you” (in its various forms), it also covers any possible co-applicant.

1.5 By accepting the Terms, you authorise us to request, at the time of making the application, on your behalf, loan offers or offers related to other financial or insurance services from our partners (hereinafter also referred to as bank, credit provider, lender or insurance provider). You also accept that we transmit the information you provide or that we collect from our partners in connection with the loan application or other service.

1.6 Finnish law applies to the relationship between you and Sortter.

1.7 You hereby expressly request and authorise us to immediately provide you with our Services described in these Terms before the end of the withdrawal period described in section 6.1.

1.8 These Terms may be amended. We will seek to inform you of possible changes to these Terms in advance.

1.9 Notice of our updated Terms will be made available on our website. In the relationship between you and us, the Finnish language is used primarily.

2. Definitions

The following words in bold have the following meanings in these Terms:

Sortter: A limited liability company registered under Finnish law, Business ID 2954352-7, registered address Bulevardi 21, 00180 Helsinki. Sortter is registered in the Trade Register and its main line of business is other financial service activities (excluding insurance and pension funding). Sortter may act as an insurance agent for certain insurance companies. Information about the represented insurance companies can be checked from the insurance intermediary register maintained by the Finnish Financial Supervisory Authority. Sortter may also act as a marketing partner for insurance providers and deliver your contact details to a partner offering the insurance you applied for. Alternatively, Sortter may provide you with further information about insurance providers and/or the insurances they offer.

Online application: Web form that you must fill in in order to apply for a loan or other product offered by our partners. It can be found on our website.

Service: Online service concerning the loan and financing comparison and tendering service (applying for a loan or saving) and/or insurance products offered to you under this agreement.

Terms: The terms concerning our Services given in this document.

We: Sortter Oy, as defined above.

Website: Commercial website currently located at www.laina.fi (or any other URL address we may notify).

You: Refers to the person, i.e. user, who now or in the future subscribes to the services we offer.

3. Registration for our Service

3.1 Our Services are available to natural persons as well as foundations, companies, other entities and charitable organisations.

3.2 In order to apply for the products we compare and tender, or for which we request an offer for you, you must fill in an application form.

We reserve the right to suspend the processing of your application immediately if Sortter considers that some circumstances are exceptional. Examples of such circumstances:

  • you do not meet our requirements related to verification of your address,
  • we have reason to suspect that you or someone else is using your data unlawfully or fraudulently,
  • you have in some context given us false information,
  • you have refused or failed to provide information requested by us or have not sent us certain assurances or statements,
  • you do not comply with these Terms in our business relationship, or
  • competent authorities specifically request us to freeze your application.

3.3 Our partners accept applicants only if they have a Finnish personal identity code and hold an appropriate method of identification. Note that the approval of your application is made on the basis of the independent assessment of our partners. In order to make a loan, financing or insurance application, you must be at least 18 years old.

3.4 If you want to fill in an application, click the relevant button (e.g. “Loan offers”) on our website and follow the instructions that appear. If you want to apply for products offered by our partners, you must fill in all sections of the application form.

3.5 You represent that the information you provide in the Service is true.

3.6 Consent

You agree that the credit decision obtained on the basis of the application, or the decision on granting another product you have applied for, may be displayed in the “My offers” section of our website.

You agree that we and/or the lending bank/credit institution/insurance company or other partner check or correct your credit information and that the information you provide on the application form may be checked. You agree that we or partners who work with us may inquire or supplement your information from third-party registers or by contacting your employer, or investigate public data in order to check the information you have provided.

You understand and agree that we do not make the credit or granting decision regarding the product you applied for. The credit or granting decision is made by one or more of our partner banks or other partners.

You authorise us to obtain information about the decision of the relevant partner regarding the granting of the product and to obtain additional information about the credit decision or other product granted by our partner. Your acceptance is required so that we can carry out our assignment as a comparison and tendering service or as an agent.

3.7 Interest Watch

You may authorise us to request loan offers from our partners on your behalf from time to time by confirming the Interest Watch service in our Service. The authorisation is voluntary and free of charge, and obtaining a loan offer does not oblige you to accept it. If you use the authorisation, we will update your loan application to our partners from time to time with the information you have provided.

You must ensure that the information you have provided to us is correct, and update your information when it changes so that the information remains up to date. If you use the authorisation, you will be sent an electronic notification before loan offers are requested, so that you can confirm the updating of your application to our partners and easily check your own data and our up-to-date privacy policy at https://sortter.fi/tietosuojaseloste/ before requesting loan offers. You may, if you wish, cancel the authorisation at any time by logging in to the “My offers” page.

4. Limitation of liability

We are not liable for any damages caused as a result of Finnish or foreign legislation, government actions, war, strike, lockout or other similar event. We are not liable in other circumstances either, if normal caution has been exercised. We are not liable for any indirect damages.

When applying for a loan or other product, it is important that you always carefully check your own income and living expenses so that you can calculate a suitable monthly instalment or other payment arrangement for the loan or other product applied for.

Sortter is not liable for any damage caused by incorrect information you provide, loss of data, alteration of data in the data network, or misuse of the Service.

You accept that information related to the Service may be processed through the contact channels you have provided (telephone, email). You are responsible for the data security and proper handling of your own devices.

For clarity, it is stated that Sortter is not a party to the agreement between you and the loan/insurance provider (bank, other financial institution or insurance company), and this agreement does not oblige you to accept a loan or insurance contract. Sortter does not participate in the drafting of the loan or insurance offers compared and tendered to you and is not responsible for their content. If you accept a loan or insurance offer, the terms of the loan/insurance contract are determined separately between you and the respective service provider. Sortter is not responsible for any obligations or damages arising from the contract between you and the loan/insurance provider and cannot guarantee that the product you applied for will be granted to you.

5. Processing of personal data

By using our Services, for example by visiting our website, applying for a loan or filling in an insurance application, you confirm that you have read and understood our privacy policy and that our current privacy policy forms part of the agreement you make with us in addition to these Terms.

You accept that we process your personal data for the purposes defined in these Terms and in our privacy policy, in accordance with EU General Data Protection Regulation 2016/679 (“GDPR”) and the Data Protection Act (5.12.2018/1050), as well as to fulfil statutory obligations binding on us. We also store information about how you use our Services; such information includes the search channel you use, the time of making the application, and the dates and subjects of contacts. When you make an application through digital channels, we use cookies and other digital tools in optimisation and tracking of search results in order to provide a good and meaningful user experience. If you apply for a loan or other product or service through us, we will disclose the personal and identification data necessary for your application to our partners processing your application in cooperation with our Service. In relation to our Service, these partners may correspondingly disclose to us information about the product offered to you and the conclusion of the contract. We or our partners may deliver information subject to bank secrecy to you by email or other electronic channels. Each partner is a controller in respect of processing your personal data for your application.

6. Right of withdrawal and complaints

6.1 You have the right to withdraw your agreement based on these Terms within 14 days from acceptance of the Terms (or from receiving these Terms, if you have chosen email or regular post as delivery method, whichever occurs later). You have the right to withdraw insurance you have taken in Sortter’s service by notifying of the withdrawal within 30 days from when you received information of the insurance taking effect. For clarity, it is stated that you cannot withdraw the application after its submission. Withdrawal of consent does not affect the lawfulness of processing carried out before the withdrawal on the basis of consent.

If you want to exercise your right of withdrawal, contact Customer Service. The minimum requirement is that the contact clearly states the intention to withdraw the agreement based on these Terms.

6.2 Possible complaints must be sent to the following address: asiakaspalvelu@sortter.fi.

6.2.1 We will seek to process your complaint as soon as possible. If the matter is more complex than normal, we will record your information and ensure that your complaint is handled thoroughly as soon as possible.

7. Termination of the agreement, disputes, applicable law and other information

These Terms and the relationship between you and Sortter are governed by Finnish law. If a dispute arises between you and Sortter concerning the Terms and it cannot be resolved through negotiation, the dispute will be settled in the district court of your domicile or, if you wish, in the district court of Sortter’s domicile. If your place of residence is not in Finland, disputes will be handled in the district court of Sortter’s domicile.

You also have the right to have disputes related to these Terms resolved through alternative dispute resolution, if the dispute meets the required conditions. We commit to contributing to the use of alternative dispute resolution in customer relationships in the manner provided in the Act on Alternative Dispute Resolution in Consumer Disputes. In Finland, consumer disputes are handled by the following body:

Before taking the matter to the Consumer Disputes Board, contact the Consumer Advisory Service (www.kuluttajaneuvonta.fi).

The European Commission has developed an out-of-court dispute resolution procedure. This gives the customer the possibility to resolve a dispute concerning online orders without initiating legal proceedings. The dispute resolution platform can be found here: http://ec.europa.eu/consumers/odr/

Our Service is valid indefinitely after you have made the first application through us. You may terminate the Service at any time by sending an email to our Customer Service (asiakaspalvelu@sortter.fi).

Upon request we will correct errors in your application and forward the corrected application data to our partners.

These Terms do not reduce your rights under the Consumer Protection Act. Pre-contractual information about Sortter’s Service has been given in accordance with Finnish law.

Sortter is supervised by the Consumer Ombudsman and the Finnish Competition and Consumer Authority (www.kkv.fi). Sortter is also registered in the insurance intermediary register of the Finnish Financial Supervisory Authority. Registration can be checked with the Authority. The Financial Supervisory Authority supervises the activities of the insurer and the insurance agent on the Finnish market.

9. Validity
